Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and EmpirePilot OS ("EmpirePilot", "we", "us") governing your use of empirepilotos.com, our mobile applications, and related services (the "Service"). By creating an account or using the Service you accept these Terms and our Privacy Policy. If you use the Service on behalf of a company, you represent that you can bind that company.
1. The Service
EmpirePilot is an AI-native business operating system: content generation, social publishing and management, CRM, AI email inbox, reviews, analytics, blogs, and automation across one or more brands. Features vary by subscription plan and may change as the Service evolves.
2. Accounts & eligibility
- You must be at least 18 years old and provide accurate account information.
- You are responsible for safeguarding your credentials and for all activity under your account. Enable two-factor authentication in Settings → Security.
- One person or entity may not maintain accounts for abusive purposes (e.g., evading limits or bans).
3. Subscriptions & billing
- Paid plans are billed monthly through Stripe on our website. Prices are shown at empirepilotos.com before purchase.
- Purchases and plan management are available on our website only. Our mobile apps do not sell subscriptions or digital goods.
- Plans renew automatically until canceled. You may cancel anytime in Settings → Billing; cancellation takes effect at the end of the current billing period. Except where required by law, fees are non-refundable.
- We may change pricing with at least 30 days' notice; changes apply from your next renewal.
- Plan limits (brands, AI usage, etc.) are enforced by the Service. We may throttle usage that exceeds your plan.
4. Your content & data
- You retain all rights to the content and data you upload or create ("Customer Content"). You grant us a limited license to host, process, and transmit it solely to operate the Service (including sending it to our AI and publishing providers on your instruction).
- You are responsible for Customer Content — including having the rights to upload it and lawful basis to store data about your own customers.
- We do not use your private Customer Content to train AI models.
5. AI-generated content
- The Service uses AI to draft content, replies, articles, and insights. AI output can be inaccurate. You are responsible for reviewing content before relying on it or publishing it, and for anything you authorize the Service to publish automatically.
- AI output is not legal, financial, tax, credit-repair, or medical advice.
- If you operate in a regulated industry (e.g., credit services, finance, hiring), you are solely responsible for compliance with the laws that apply to your business (e.g., CROA, FCRA, TCPA, CAN-SPAM). The Service flags and holds drafts for review in regulated contexts, but the final responsibility is yours.
6. Connected accounts & third-party platforms
- You may connect email mailboxes, social accounts, payment accounts, and websites. You represent that you own or are authorized to connect them.
- Publishing to social platforms is subject to those platforms' own rules. Violations (spam, community-standards strikes, suspensions) are between you and the platform; we may pause publishing to protect your accounts and our infrastructure.
- Third-party services may fail or change their APIs; we are not liable for their downtime or actions.
7. Acceptable use
You agree not to use the Service to:
- send spam or unsolicited messages, or violate TCPA/CAN-SPAM or similar laws;
- publish unlawful, deceptive, infringing, or harmful content;
- make guarantees prohibited in regulated industries (e.g., guaranteed credit-score outcomes);
- probe, disrupt, or overload the Service, or access another tenant's data;
- resell the Service except under a plan that expressly permits it (White Label / Agency).
We may suspend or terminate accounts that violate these Terms, with notice where practicable.
8. Termination & deletion
You may stop using the Service and delete your account at any time in Settings → Security → Delete account (see how deletion works). Upon deletion, your data is permanently removed as described in the Privacy Policy. Sections that by their nature survive (billing obligations, disclaimers, limitation of liability) survive termination.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI OUTPUT WILL BE ACCURATE OR ACHIEVE ANY PARTICULAR BUSINESS RESULT.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMPIREPILOT WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE (OR $100 IF YOU PAID NOTHING).
11. Indemnity
You will indemnify and hold us harmless from claims arising out of your Customer Content, your use of the Service in violation of these Terms, or your violation of law or third-party rights.
12. Governing law & disputes
These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Georgia, and you consent to their jurisdiction. Either party may seek injunctive relief for misuse of intellectual property or data.
13. Changes to these Terms
We may update these Terms as the Service evolves. Material changes will be announced in the app or by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
